Removal Assistance:Buyers are solely responsible for the removal of purchased items.

Buyer shall defend, indemnify and hold Auctioneer and staff harmless from any and all damages or claims of others arising from Buyer's breach of Buyer's obligations set forth above. Buyer's Premium: There is a 15% Buyer's Premium in effect for this auction.

The auction will be conducted by Northstate Auctions on behalf of the owners of the property, referred to as the Seller. The term Auctioneer shall include, but is not limited to, any and all of its employees and directors. The auction shall be governed by the terms set forth herein (the Agreement) and any pre-auction announcements.

The Auction will be conducted by offering the items per lot. Each lot or item is the subject of a separate sale. Auctioneer reserves the right to include in the auction any item and the right to withdraw any item. Auctioneer may combine, subdivide, regroup or reorganize any items. The bidder offering the highest bid accepted by the Auctioneer shall be the purchaser of the offered lot, and no purchaser shall retract his bid once the bid is accepted. Any dispute arising as to any bidding shall be settled by Auctioneer at his sole discretion, and Auctioneer may put the lot in dispute up for sale again. Auctioneer reserves the right to refuse any bid. If a dispute arises after the sale of any item, the Auctioneer records shall be deemed conclusive in all respects. All sales are final!

Northstate Auctions reserves the sole right to determine and state what items may be deemed “Upon Consignor Approval”.

Buyer has FULL responsibility in regards to the Internet account. No changes or refunds will be made in any way if Buyer fails to competently protect their Internet bidder account. It is Buyer’s sole responsibility to keep pets, children and mysterious or random persons or entities from bidding with their account information. Passwords and account information should be kept private.

Photographs

Photographs contained in the online auction are property of Northstate Auctions and may not be used or copied without permission. Photographs may be cropped or have lighting changes but are not photo-shopped or touched up in any way. Photographs may or may not contain all the items in the lot, but all items must be taken if a lot is purchased; even if it is not represented in the photograph. Northstate Auctions does it’s best to correctly represent all lots in the best manner through the photographs taken, but does not guarantee that all items in the photograph are part of the lot represented. Do not rely on our photographs alone for your bidding; make proper use of the inspection date!

Payments

Payment in full must be made at the conclusion of the auction. Payments to be made in cash, cashier’s check, Visa, MasterCard, or certified check. Personal and business checks are not accepted. Bidder agrees to be responsible for the payment of the purchase price, Auctioneer’s fees, any applicable DMV fees and taxes due on all bidder purchases. Northstate Auctions reserves the right to refuse/require/limit certain payment methods to customers deemed high risk by management.

Upon making payment for an item, no stop payment of funds will be honored. Any stop payment order or reverse charges order of a check/credit card, or issuing a check which is returned marked insufficient funds, shall be deemed by the parties to be prima facie evidence of fraud existing at the time the transaction was consummated and shall be construed by the parties as intent to defraud. (Note: Bidder deposit non-refundable upon non-payment of merchandise.)

Interest on overdue accounts will be paid by the purchaser at maximum rate allowed by law.

State and local sales tax will be assessed and collected on all purchases unless legal exemption documentation is provided at the time of sale in the form of a Resale Certificate or a Bill of Lading (must be provided at time of payment).

MOTOR VEHICLE PURCHASES

Titles and/or any supporting documents will be reviewed with the winning bidder after the auction has ended and the winning bidder has set an appointment for review within the item pick up Terms and Conditions. No titles will be given out on auction day.

A $45 document processing fee will be charged for every DMV purchase, whether sold independently or grouped into one Lot and regardless of purchasers intended use of the purchase. Current smog fees will be charged to all applicable vehicles.

California law does not provide for a cooling off or other cancellation period for vehicles. Therefore you cannot later cancel a contract simply because you change your mind, decide the vehicle costs too much, or wish you had acquired another vehicle.

Mileage: Any mileage in the catalog or announced is for references only. No guarantees are made to mileage unless otherwise stated. Actual mileage is not represented or guaranteed by Northstate Auctions. Buyer must determine actual miles in each instance by previewing item in person.

Fees: Any fees posted either in the catalog, on web-site, or on the vehicle are due to California DMV, and will be collected by Northstate Auctions. These fees do not apply if you take the vehicle out of California; Please seehttp://www.dmv.ca.gov/portal/dmvfor their requirements in these cases. Also, certain bankruptcy or lien sale fees are still applicable with no regard for which state you reside. If you have questions, please inquire before you purchase the vehicle.

Some Vehicle Disclaimer Definitions:


Lost Title Form: The California title to this vehicle has been lost and a replacement must be applied for from the CA DMV. Any CA DMV fees due must be paid before a replacement title will be issued.

Salvage: A salvage vehicle is a vehicle that has been wrecked, destroyed, or damaged to such extent that the insurance company considers it uneconomical to make repairs to the vehicle and the vehicle is not repaired by or for the person who owned the vehicle when the damage occurred. The California title will contain a notation identifying this vehicle as a salvage vehicle.

Junked: A junked vehicle is one which has been dismantled because it was wrecked, abandoned, or a low valued vehicle that was impounded and acquired from an enforcement agency and is no longer operable.

Nonrepairable vehicle: is a vehicle of a type otherwise subject to registration that meets the following criteria:

A vehicle that has no resale value except as a source of parts or scrap metal, and which the owner irreversibly designates solely as a source of parts or scrap metal. The vehiclecannotbe titled or registered for use.


AS-IS Parts Only= Bill of Sale Only: These vehicles are being sold forparts, not as a whole unit. No paperwork for this item will be provided, other than your paid in full invoice which is your Bill of Sale, and the form REG 262 which is for Northstate Auctions records.NOTE: Parts Only vehicles canbe difficult to register and/or can be unable to be registered in some cases.

ABSOLUTELY NO refunds or changes will be made because of a buyer's failure to understand terms and conditions. There are no exceptions. PLEASE read and make sure to understand all disclaimers before you purchase a vehicle.

Disclosure Requirements

California sellers of vehicles subject to the regulations must notify the buyer that the vehicle may be subject to retrofit or accelerated replacement requirements and to print the disclosure on the bill of sale, sales contract addendum, or invoice. In addition, the seller must keep records of the disclosure notice for three years for each buyer. Sellers should provide the disclosure prior to the sale so that the buyer can be aware of the regulation when making a purchase decision.

The requirements are specified in title 13, California Code of Regulations, section 2025 which directs the seller to make the following text available to the buyer:

“An on-road heavy-duty diesel or alternative-diesel vehicle operated in California may be subject to the California Air Resources Board Regulation to Reduce Particulate Matter and Criteria Pollutant Emissions from In-Use Heavy-Duty Diesel Vehicles. REMOVAL OF ITEMS &STORAGE FEES

Removal of all items shall be the sole responsibility of the purchaser. Loading assistance is provided as a courtesy; however, purchaser assumes all risk and responsibility for loading and removal of purchases. Auctioneer reserves the right to require proof of adequate insurance coverage from any purchased items requiring dismantling, rigging or hot cutting. Purchaser agrees to indemnify and save harmless both, consignor and Auctioneer, its officers, directors, employees, against any damage caused by the acts of purchaser. All items must be removed from the auction facility as per announced auction day, unless otherwise stated. If for any reason purchaser fails to remove any purchase within the time specified, the purchase shall be deemed abandoned, and Auctioneer at its sole discretion may resell or dispose of the items. Purchaser may be liable for any rent incurred or damages suffered by Auctioneer because of purchaser’s failure to remove any item.Failure to remove items may result in a rental/storage fee of not less than $25 per day.

If for any reason, Auctioneer is unable to make available any purchase during pick-up days specified in the Terms and Conditions, Auctioneer's sole liability shall be the return of monies paid.


Purchaser is responsible for insuring his purchases immediately. Northstate Auctions shall not be responsible for loss, damage, or theft of any purchase.Purchaser shall not be entitled to inspect or remove any item from the auction facility until all his purchases are paid for in full including all applicable taxes and fees.

Bidder acknowledges that an auction site is a potentially dangerous place. Flammable, noxious, corrosive and pressurized substances are present, heavy equipment is being operated and electric circuits may be live. Every person at the auction site, at any time, shall be there at his own risk without notice of the condition of the premises and the activities thereon and bidder shall so advise his agents, employees and be held responsible for any minors with him/her. No person shall have any claim against Auctioneer, its officers, directors, agents, employees, principals, for any injuries sustained, nor for damages to or loss of property, which may occur from any cause whatsoever.

No photographs, tape recording and/or video recordings of any type are permitted without the express written prior approval of Auctioneer. It is understood, however, that Auctioneer, including its agents, representatives, may be taking pictures and video for future commercials or advertisem*nts. The use of a photograph or video with Buyer's image or likeness is hereby authorized.

If any provision of this Agreement is declared or determined to be null, void, inoperative, illegal or invalid for any reason, the validity of the remaining parts, terms or provisions will not be affected thereby and they will retain their full force and effect, and said null, void, inoperative, illegal or invalid part, term or provision will not be deemed to be part of this Agreement.

Each party to this Agreement acknowledges that it has read, or has had the opportunity to read, the terms provided herein. The parties agree that this Agreement reflects the terms as agreed to by the parties hereto. In the event a term or terms is considered ambiguous, neither party hereto, nor their respective counsel, will be considered the draftsperson of this agreement for the purpose of causing the terms of this Agreement to be construed against a party hereto.

The parties hereto acknowledge and agree that this Agreement is made and entered into in the State of California, and will be in all respects to be interpreted, enforced and governed under the internal laws (and not the conflicts of laws) of the State of California. In the event that the parties hereto, or any one of them, litigate any actual or potential breach of this Agreement, the parties hereto stipulate and agree to jurisdiction and continuing venue for any such action in the County of Butte, State of California.

All rights granted herein are personal and exclusive to the registered bidder, and may not be assigned or transferred to another person or entity, by operation of law or otherwise. Any attempt to assign or transfer any such rights shall be void and unenforceable. No third party may rely on any benefit or right conferred herein or granted to any bidder.
